Can Chinese people finalize the divorce in absentia in Vietnam?
Regarding Lan H’s question: Can a Chinese citizen finalize a divorce with a Vietnamese spouse in absentia at the Vietnamese court because her boyfriend is currently in China and cannot come to Vietnam?
Nhat Thu Law responds as follows:
According to current regulations, unilateral divorce cannot be delegated to another person. If one of the parties is absent at the trial, it will be resolved as follows:
- The absent party has requested to be tried in absentia.
- A representative of the absent party participates in the trial.
- Absence due to force majeure or objective obstacles.
Accordingly, the absence is handled as follows:
- If the defendant is absent for the first time, the court will postpone the trial. However, if they are absent a second time, the court will proceed with the trial in their absence.
- If the plaintiff (the person requesting the divorce) is absent after two court summons, it will be considered as abandonment of the divorce request. The court will suspend the unilateral divorce proceedings in this case.
However, if the plaintiff submits a written request to proceed in their absence, they can still get a divorce without needing to return to Vietnam. Therefore, Lan H and her boyfriend don’t need worry too much about having to go to Vietnam to complete the procedures.
